تبحث هذه الدراسة في موقع سورية على مسار الانتقال بعد سقوط النظام عام 2024، وتجادل بأن ما انهار لم يكن مؤسسات الدولة، بل النموذج السلطوي الذي هيمن عليها طوال عقود. فعلى الرغم من بقاء الجهاز الإداري قائمًا، ما يزال الانتقال معلّقًا بين شرعية ثورية فقدت قدرتها على إنتاج قواعد عامة، ومشروعية دستورية لم تكتمل بعد. وتقدّم الدراسة قراءة نقدية للإعلان الدستوري الانتقالي لعام 2025، مبيّنة محدوديته في تحويل السلطة الثورية إلى شرعية مؤسسية مستقرة. وتتناول الدراسة إعادة بناء مؤسسات الدولة، ولا سيّما القضاء والقطاع الأمني، حيث بدا أن جهود الإصلاح الراهنة جزئية وهشّة، وأنها غالبًا ما تعيد إنتاج اختلالات المنظومة السابقة. وتبيّن أن هناك غيابًا لمنظومة فعلية للعدالة الانتقالية قادرة على كشف الحقيقة ومساءلة المنتهكين وضمان عدم التكرار، وتشير إلى أنّ وجود هذه التحديات ضمن بيئة جيوسياسية معقّدة يحدُّ من القدرة على استعادة القرار السيادي. وتخلص إلى أن سورية تقف عند لحظة تأسيسية غير مكتملة، وأن مستقبل الدولة مرهونٌ ببلورة إرادة مؤسسية وسياسية قادرة على الانتقال من منطق الثورة إلى منطق الدولة.
Abstract:
This paper seeks to examine Syria’s position in the post-2024 transition following the collapse of the authoritarian system. It argues that what fell in 2024 was not the state itself, but the coercive model that had dominated its institutions for decades. Although state structures survived the collapse, the transition has remained suspended between an exhausted revolutionary legitimacy and an incomplete constitutional framework. The study offers a critical reading of the 2025 Transitional Constitutional Declaration, assessing its limited capacity to transform revolutionary authority into institutional legitimacy. It also analyzes the rebuilding of state institutions—focusing on the judiciary and security sector—revealing that current reform efforts remain partial, structurally fragile, and often reproduce elements of the former system. Furthermore, the paper highlights the absence of an operational transitional justice framework capable of establishing truth, accountability, and guarantees of non-recurrence. Finally, it situates these internal challenges within a complex geopolitical landscape that constrains sovereign decision-making. The paper concludes that Syria stands at an unresolved founding moment whose outcome depends on developing the institutional will and political consensus necessary to shift from revolutionary authority to a rule-based state.
